TERMS AND CONDITIONS OF SALE
PREAMBLE
These Terms and Conditions of Sale (“Terms”) govern the sale of all products offered by Ex-Libris Paris (“we,” “our,” or “us”) through our website https://www.exlibris.paris (the “Website”), including but not limited to custom ex-libris stamps, wooden stamps, inkwells, and books (collectively, the “Products”) to customers (“the customer”).
ARTICLE 1 – CUSTOMER
1.1. The customer confirms that they are a natural person acting as a consumer, of legal age, and legally capable under the laws of their country of residence. If the customer is a minor, parental authorization from a legal guardian must be sent to us at bonjour@exlibrisparis.fr before placing an order.
1.2. Ex-Libris Paris reserves the right to decline any order that does not meet the conditions above.
ARTICLE 2 – SCOPE
2.1. Our ex-libris are one-of-a-kind pieces, custom-designed and engraved based on original illustrations created according to the client’s specifications. As described on our Website, each shipment includes a custom ex-libris stamp mounted on wood and an inkwell.
2.2. Once an order is confirmed on our Website, an initial design will be sent to the email address provided by the customer. If the design does not meet the customer’s expectations, one (1) revision may be requested. Beyond that, no further revisions will be accepted, and the customer must select one of the proposed designs for production.
ARTICLE 3 – ORDERS
3.1. Any confirmed order implies full and unreserved acceptance of these Terms, available via a clickable link at the bottom of our Website. These Terms cannot be modified by any customer’s additional statements, regardless of when they are brought to our attention.
3.2. A confirmed order constitutes a sales contract and acceptance of these Terms. Ex-Libris Paris will send an email confirmation summarizing the order details before shipment. The customer is responsible for providing a valid email address and verifying the accuracy of the order information.
3.3. Ex-Libris Paris shall not be held liable for failure or improper execution of an order due to force majeure or causes beyond our control. If we are held liable, any damages claimed by the customer shall not exceed the total amount of the order.
ARTICLE 4 – USE OF PRODUCTS
4.1. Our ex-libris are intended for personal use only, unless express written permission is granted by Ex-Libris Paris.
4.2. Any breach of this provision may lead to legal action against the customer or any third party using the ex-libris unlawfully.
ARTICLE 5 – PRICING
5.1. All prices are listed in euros, including VAT, but excluding shipping, which is the responsibility of the customer.
5.2. Shipping fees are shown before payment. They are:
• €4.95 for deliveries within mainland France
• €10 for deliveries to other countries
5.3. For deliveries outside France, the customer may be liable for additional charges such as customs duties, import taxes, or local/state taxes. These fees are the customer's responsibility and must be paid in full to ensure delivery. Ex-Libris Paris cannot be held responsible for any such charges or delays related to customs clearance.
ARTICLE 6 – PAYMENT
6.1. Payment is made by credit card. We accept CB, Visa, and MasterCard. Payment transactions are securely processed via Stripe.
6.2. Payment is encrypted using SSL (Secure Socket Layer) technology. Stripe is solely responsible for processing and storing payment data.
6.3. Ownership of the product passes to the customer only upon full payment. Partial payments are not accepted.
ARTICLE 7 – DELIVERY
7.1. We deliver to France and internationally, using the address provided by the customer during checkout. Ex-Libris Paris shall not be held responsible for loss or misdelivery due to incorrect or incomplete shipping information provided by the customer.
7.2. For “urgent” products:
• Semi-custom orders are shipped within 72 hours.
• Fully custom orders are designed within 72 hours (with additional time for production and delivery).
Delays do not entitle the customer to cancel the order, refuse delivery, or claim compensation.
7.3. Delivery timelines are provided for reference only. Ex-Libris Paris cannot guarantee specific delivery dates due to potential logistical constraints. We are not liable for any delays or non-deliveries caused by third-party shipping services.
ARTICLE 8 – RETURNS & EXCHANGES
8.1. In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to custom-made or personalized goods. Therefore, no cancellations or refunds will be accepted once an order is confirmed, except in the case of a manufacturing defect or product non-conformity.
8.2. Products are created exactly as described on the Website and based on the custom design approved by the client. Minor differences between the final product and the approved design do not constitute defects. No returns or refunds will be accepted on these grounds.
ARTICLE 9 – INTELLECTUAL PROPERTY
All texts, comments, illustrations, and images on our Website are protected under intellectual property laws in France and internationally. Any reproduction, in whole or in part, outside the scope of exceptions outlined in Article L122-5 of the French Intellectual Property Code is strictly prohibited.
Unauthorized use constitutes counterfeiting, punishable under French law by up to 3 years in prison and a €300,000 fine.
ARTICLE 10 – PERSONAL DATA
10.1. The customer's personal data is processed by Ex-Libris Paris for order fulfillment and compliance with legal obligations. Data is retained for up to 5 years after the order to facilitate product support and warranty claims.
10.2. The data controller is Lauren Easum, President of ATHENA (Ex-Libris Paris), located at 60 rue François 1er, 75008 Paris, France. Contact: bonjour@exlibrisparis.fr. Data access is restricted to Ex-Libris Paris employees who require it for their work.
10.3. In accordance with EU Regulation 2016/679 (GDPR) and French data protection laws, customers have the right to access, correct, delete, or transfer their personal data, and to object to its use for legitimate reasons. These rights can be exercised by contacting us at the above address and providing proof of identity.
Customers may also lodge a complaint with the CNIL (French Data Protection Authority).
ARTICLE 11 – APPLICABLE LAW & DISPUTES
These Terms are governed by French law.
Any dispute relating to their interpretation or execution shall be submitted to the exclusive jurisdiction of the courts of Paris, France.
